These Terms of Service (“Terms”) govern your use of Promotion Margin Guard (“PMG,” the “App,” “we,” “us,” or “our”), a Shopify application developed by Tyemi App. By installing, accessing, or using Promotion Margin Guard, you agree to these Terms.
1. The Service
Promotion Margin Guard is a software tool designed to help Shopify merchants simulate percentage-based promotions, compare projected margins against a merchant-defined minimum margin floor, classify product variants based on available price and cost information, and create protected Shopify discounts for eligible variants.
Features may change, improve, or be removed over time as the App evolves.
2. Eligibility and Shopify Account
You must have authority to install and use apps for the Shopify store on which Promotion Margin Guard is installed. Your use of Shopify remains subject to Shopify’s own terms, policies, and platform requirements.
3. Merchant Responsibility for Data Accuracy
Promotion Margin Guard relies on information available from your Shopify store, including product prices and product cost information. You are responsible for ensuring that your prices, costs, and other store data are complete and accurate.
If product cost information is missing, inaccurate, outdated, or incomplete, margin calculations and eligibility decisions may also be incomplete or inaccurate. PMG may exclude variants when a margin cannot be verified.
4. Margin Calculations and Business Decisions
Promotion Margin Guard provides software calculations and operational tools based on the information available to the App. It does not provide accounting, tax, legal, investment, or financial advice.
You remain responsible for reviewing promotions before publication and for all pricing, margin, inventory, merchandising, tax, accounting, and business decisions made for your store.
5. Subscriptions and Billing
Paid subscriptions are offered through Shopify App Pricing. Current prices, billing intervals, trial terms, and subscription options are displayed through Shopify at the time you select or approve a plan.
Shopify handles subscription approval and billing. Any cancellation, billing-cycle treatment, or refund rights are subject to the applicable Shopify billing flow, these Terms, and applicable law.
6. Acceptable Use
You may not misuse Promotion Margin Guard, attempt to gain unauthorized access to the App or its infrastructure, interfere with its normal operation, reverse engineer the service except where applicable law expressly permits it, use the App to violate law or third-party rights, or use automated methods to abuse or overload the service.
7. Third-Party Services
Promotion Margin Guard depends on third-party services, including Shopify and infrastructure providers. Availability or functionality may be affected by outages, changes, limitations, or policies of those third parties.
We are not responsible for third-party services outside our reasonable control.
8. Intellectual Property
Promotion Margin Guard, its software, branding, site content, visual identity, and related materials are owned by Tyemi App or its licensors, except for third-party trademarks and materials belonging to their respective owners.
These Terms give you a limited right to use the App for your Shopify store while your access is authorized. They do not transfer ownership of the App or its intellectual property.
9. Availability and Changes
We aim to operate Promotion Margin Guard reliably, but we do not guarantee uninterrupted or error-free availability. Maintenance, platform changes, security events, infrastructure issues, or other circumstances may temporarily affect the service.
We may update the App to improve functionality, security, compatibility, or compliance.
10. Suspension and Termination
You may stop using Promotion Margin Guard by uninstalling the App and, where applicable, ending your subscription through Shopify.
We may suspend or terminate access where reasonably necessary to address security risks, unlawful activity, abuse, non-payment, material violations of these Terms, or requirements imposed by Shopify or applicable law.
11. Disclaimer
To the maximum extent permitted by applicable law, Promotion Margin Guard is provided on an “as is” and “as available” basis. We do not guarantee that every margin calculation, promotion outcome, Shopify platform response, or third-party integration will always be error-free or uninterrupted.
Nothing in these Terms excludes rights or warranties that cannot legally be excluded.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Tyemi App will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business opportunities, or loss of data arising from use of or inability to use the App, except where such limitation is prohibited by law.
Nothing in these Terms limits liability that cannot legally be limited.
13. Privacy
Our handling of information is described in the Promotion Margin Guard Privacy Policy.
14. Changes to These Terms
We may update these Terms from time to time. The current version will be posted at this location with an updated effective date when appropriate. Continued use of the App after revised Terms become effective constitutes acceptance where permitted by applicable law.
